Massachusetts Probate and Family Court A Team Approach to Divorce,
Family Law & Personal Injury
Our practice works as a team with each family law and personal injury client,
bringing more than seventy years of combined legal experience to the litigation of each case.*
In each civil and family law case, two experienced attorneys are involved
in developing the best possible strategy for achieving our client's goals.
Given his experience representing individuals on either side of marital law cases, as well as
appointments by the Probate Court to serve as a guardian ad litem,
Attorney Neil Kerstein has extensive experience in child custody, visitation, marital asset evaluation
and the complexities of Probate & Superior Court procedure.
He has, for example, represented his client in a divorce resulting in a sizable alimony award and a
property award valued at approximately 1.1 million dollars. Attorney Kerstein has also been appointed by several judges
of the Probate and Land Courts as a Commissioner authorized to sell properties in eastern Massachusetts.
Attorney John Bena brings over thirty years of litigation experience to the handling of family law
and personal injury cases. Since his first trial in 1987, he has devoted much of his practice to administrative
hearings and has argued before judges throughout Massachusetts.
Attorney Bena has extensive experience with both mediated and privately negotiated settlements
and has served as a court designated conciliator for both the Stoughton and Brockton courts.
He has lectured on the law to corporate and community groups and has been an Instructor in the
School of Business at Northeastern University in Boston, Massachusetts.
* Workers Compensation & Social Security Disability Claims are handled exclusively by Attorney Bena
